Al-Azhar University Hosts Forum on Contemporary Transaction Jurisprudence

Today, Al-Azhar University is hosting the 56th Jurisprudential Forum titled “Contemporary Perspectives,” focusing on transaction jurisprudence and the legal rulings concerning the right of preemption.

The forum features Dr. Mahmoud Abdel Jawad, a professor of jurisprudence at Al-Azhar University’s Faculty of Sharia and Law, and a member of the Grand Mufti’s Fatwa Committee at Al-Azhar. Also participating is Dr. Ahmed Lotfy Zaki, an assistant professor of jurisprudence and head of the jurisprudence department at the Islamic and Arabic Studies College in Desouk. The discussion will be moderated by Samir Shahab, a journalist with Egyptian television.

Dr. Abdel Monem Fouad, the general supervisor of Al-Azhar’s sections, emphasized that this forum serves as an important platform to clarify the close relationship between medicine and Islamic law across various aspects of life. He noted that it reflects Al-Azhar’s efforts to provide comprehensive solutions that align with Islamic teachings and contemporary challenges. He stated: “The right of preemption is one of the most significant legal rulings established by Islam to regulate financial transactions, protect property rights, and prevent harm that may arise from a new partner or neighbor who may not align with the community’s nature or residents.”.

He further explained that the legislation surrounding preemption was not arbitrary but aimed at achieving noble legal objectives, primarily preventing harm, ensuring property stability, and safeguarding rights by granting existing partners priority in purchasing adjacent properties before outsiders.

Dr. Hani Awda noted that this forum represents an important step towards enhancing public awareness regarding the significance of both legal and medical issues. He stressed the necessity of fostering a community aware of the importance of upholding Islamic values in light of medical advancements.

He added that the system of preemption in Islam strikes a delicate balance between “freedom to manage property” and “the partner’s right to protect their assets.” It serves as a safeguard against outsiders who might cause harm to neighboring communities or partners, thereby enhancing financial and social stability.

This forum continues a series of events aimed at fostering constructive dialogue within our communities. It is scheduled to take place every Monday after Asr prayer at the Ottoman canopy in Al-Azhar Mosque.
