Education Ministry Extends Service for Retired Teachers Until End of Academic Year

The Ministry of Education and Technical Education has issued a directive to educational directorates across the governorates regarding the extension of service for teachers reaching retirement age during the academic year.
The letter refers to Law No. 169 of 2025, which amends certain provisions of the Education Law established by Ministerial Decision No. 139 of 1981, regulating the procedures for terminating service and teacher files upon reaching retirement age from the start to the end of the academic year.
In light of Article 88 of the aforementioned law, the letter instructs directors to adhere to the following:.
- Not to apply the second paragraph of Article 88 of Law No. 169 of 2026 to members of the teaching staff subject to Ministerial Decision No. 259 of 1995 regarding chronic illnesses that entitle a patient to exceptional leave with full pay.
- To take necessary legal actions concerning teachers who are absent from work, while ensuring that all financial entitlements for absent teachers reaching legal retirement age are suspended until legal proceedings are completed.
Content of Article 88 of the Education Law
Article 88 states:.
Subject to the provisions of the Social Insurance and Pensions Law (Law No. 148 of 2019), a public employee’s service will end for reasons specified in the Civil Service Law (Law No. 81 of 2016). However, if a member of the teaching staff reaches retirement age during the academic year, they shall remain in service until the end of that academic year.
In cases deemed necessary, a decision may be made by the President or their delegate based on a proposal from the Minister of Education and Technical Education to extend service for any teaching staff member engaged in teaching in areas where there is actual need, based on their preference and capability, for one year, renewable annually up to three years.
Without prejudice to Article 41 of the aforementioned Social Insurance and Pensions Law, those who remain in service until the end of the academic year and have their service extended according to paragraph three shall be entitled to their insurance rights upon reaching retirement age, in addition to their full salary, with deductions for old-age insurance contributions ceasing upon reaching that age.
The Prime Minister will issue a decision based on a proposal from the Minister of Education and Technical Education regarding regulations and procedures for extending service as stipulated in paragraph three.
